Fundamentos, Práctica y Recomendaciones Para una Política Efectiva de Protección al Consumidor

Abstract

Este trabajo revisa las atribuciones del SERNAC, sus traslapes con otros reguladores y la robustez técnica de sus estudios. No obstante los fundamentos microeconómicos para una política activa de protección de los derechos de los consumidores, este trabajo concluye que en Chile no hay consenso respecto de la importancia, validez y necesidad de tal política, sin perjuicio de la reciente modificación legal en que se fortalece al SERNAC en el ámbito de los servicios financieros. Se entregan siete recomendaciones para fortalecer esta política: revisar la supletoriedad de la ley, crear un tribunal especializado, permitir al SERNAC zanjar ciertas reclamaciones, fortalecer las organizaciones de consumidores, obligar a las empresas a mantener un registro público de reclamos, estudiar restricciones adicionales a inhabilidades y dedicación de directivos del SERNAC; y, perfeccionar los procedimientos en los estudios que lleva a cabo este organismo.
