Abstract

Cette contribution a pour objet d'analyser, dans une perspective à la fois économique et juridique, le choix des autorités de régulation économique et financière, de se doter d'un barème pour les sanctions qu'elles sont susceptibles de prononcer, à partir de l'exemple de l'AMF et de l'Autorité de la concurrence . Nous présenterons tout d'abord le contexte dans lequel ces deux autorités sont amenées à définir leur politique de répression des atteintes au marché (I), puis nous exposerons les choix différents qu'elles ont effectivement faits en matière de barèmes de sanctions (II), et enfin nous discuterons l'opportunité pour les autorités de se doter d'un barème de sanctions au regard des arguments juridiques et économiques (III).
