Fusion CE-CHSCT-DP : la fin d'une époque

Abstract

La réforme du code du travail proposée par Emmanuel Macron prévoit la mise en place dans les entreprises d'au moins 50 salariés d'un comité social et économique (CSE) exerçant toutes les attributions auparavant dévolues aux délégués du personnel (DP), au comité d'entreprise (CE) et au Comité d'Hygiène, de Sécurité et des Conditions de Travail (CHSCT). Par ailleurs et sous réserve qu'un accord soit signé entre les partenaires sociaux, la réforme envisage d'aller plus loin en instituant un conseil d'entreprise exerçant l'ensemble des compétences du CSE auquel s'ajoutera la possibilité de négocier et de conclure des accords d'entreprise, autrement dit des attributions jusque-là réservées aux délégués syndicaux. Cette réforme marque la fin d'une époque où coexistaient plusieurs instances représentatives du personnel (IRP) dans les entreprises. Mais quel est l'intérêt de cette réforme ? Est-ce vraiment une si bonne idée de fusionner les IRP ?
