Abstract

Le droit social français se caractérise par un haut niveau de rigidité préjudiciable à la performance macroéconomique du pays. Pour impérieux qu'il soit, le nécessaire assouplissement de la réglementation ne peut s'opérer au détriment du rôle protecteur du droit social. Plutôt que pour une réduction du champ dévolu au droit réglementaire, il convient de plaider pour une substitution progressive du droit conventionnel à celui-ci. L'Accord national interprofessionnel du 11 janvier 2013 s'inscrit dans cette logique tant par son contenu que par la méthode transpartisane mise en œuvre. Il propose des avancées importantes, susceptibles de concilier protection des travailleurs et efficacité économique. Il s'agit cependant d'une première étape d'une refondation du droit social qui en développerait à la fois la fonction protectrice et l'efficacité économique.
