10. Refonder le droit social par la négociation collective : que faire ?

Abstract

French social law is characterized by important rigidities which can harm the macroeconomic performance of the country. While it is urgent for regulations to be softened, it cannot be done at the detriment of the protective function of social law. Rather than advocating for a reduction of the field of regulatory laws, we argue for a progressive substitution of conventional laws for regulatory laws. The National Interprofessional Agreement (January 2013) falls within this logic not only by its content but also by its transpartisan method. This agreement calls for important advances, likely to reconcile workers protection with economic efficiency. This is a first step towards the reorganization of the French social law. It would develop both the protective function and economic efficiency.
