Abstract

L'auteur s'interroge quant a la solution retenue,par un arret de la cour de cassation en chambre criminelle, ainsi que la portee d'un tel arret qui traite du probleme de la qualification juridique du contrat qui lie une entreprise de transport a ses chauffeurs. Elle met en exergue le developpement de ce type de contentieux qui n'a pour finalite le plus souvent que d'echapper aux lois sociales. D'ou l'importance d'un contentieux devant les juridictions penales.
