Los consorcios de patentes como alternativa de gestión de los derechos de propiedad industrial

Abstract

Resumen En el documento se presenta de manera sintética un balance sobre los beneficios y posibles efectos negativos de los consorcios de patentes. Igualmente, se establecen los principales retos de las autoridades que vigilan la competencia y las que promueven el desarrollo y transferencia tecnológica. Se identificó que si bien los consorcios de patentes son una forma de articular la propiedad industrial, no per se conducen al acceso, distribución o transferencia tecnológica. Se encontró también que la literatura considera las conductas de los agentes que conforman los consorcios y el grado de sustituibilidad o complementariedad de las patentes incluidas, como algunos de los factores que establecen las ventajas y desventajas de estos acuerdos de colaboración.
