Reflexiones sobre la biodiversidad en el TLC

Abstract

Uno de los temas más nuevos en el debate sobre el desarrollo es el de la falta de equidad social en el acceso a los recursos genéticos. Hay un enfrentamiento de intereses entre los países desarrollados y los países en desarrollo, en torno a la conveniencia de adoptar medidas que evitan la biopiratería. En Colombia, recién con las negociaciones del TLC se trató de iniciar el debate de los recursos genéticos, la propiedad intelectual y los conocimientos tradicionales. Si bien es cierto, las negociaciones del TLC ya se cerraron, todavía queda mucho por decir al respecto. El TLC no logró los objetivos que perseguía la propuesta de biodiversidad presentada por los Andinos y, por el contrario se ajusta a los intereses norteamericanos. El TLC legitima la biopiratería, al no reglamentar requisitos que inplementen el Convenio sobre Diversidad Biológica en el capítulo de patentes.
