Abstract

Property valuers come to court as Expert witness in the family law courts of Australia and give there opinions of property valuers. The valuers fill in the ‘art” not the science. However are their opinions always correct? As an expert witness they are not allowed to be influenced by financial gain or have a conflict of interest. This paper will show that valuers do come to the courts with predetermined values in family law matters. Clients hire particular valuers to place a value on a residential property that is in their favour. So are the valuers giving an opinion and fulfilling the requirements of the court? A valuer must reveal as far as possible the reasoning process actually employed so as to enable the court to evaluate the evidence and the experts conclusion – this is clearly not the case.
