Schwellenwerte in der landesplanerischen Steuerung des großflächigen Einzelhandels und ihre Begründung: Ein Blick in andere Bundesländer

Abstract

Der vorliegende Beitrag geht der Frage nach, welche quantitativen Schwellenwerte in den Bundesländern Bestandteil landesplanerischer Festlegungen sind, wie diese begründet werden sowie welche praktischen Erfahrungen und gerichtlichen Entscheidungen zu diesen Schwellenwerten vorliegen. Ziel ist es, die Möglichkeiten der Verwendung quantitativer Schwellenwerte in den neuen landesplanerischen Festlegungen zur Steuerung des großflächigen Einzelhandels in NRW auszuloten. Im Ergebnis werden erhöhte Anforderungen an die Begründung von quantitativen Schwellenwerten konstatiert. Aufgrund dieser Anforderungen, verbunden mit bestimmten siedlungsstrukturellen Gegebenheiten in NRW, wird trotz der praktischen Vorteile dieser Schwellenwerte von deren Aufnahme in landesplanerische Festlegungen weitgehend abgeraten. Empfohlen wird in den landesplanerischen Festlegungen lediglich eine prozentuale Höchstgrenze (10 % der Gesamtverkaufsfläche) für zentrenrelevante Randsortimente beim großflächigen Einzelhandel mit nicht zentrenrelevanten Hauptsortimenten außerhalb der zentralen Versorgungsbereiche.
