Economic and Legal Aspects of Mitigation of the Natural Disaster Effects on the Example of Floods in Poland

Abstract

This article concerns a legal-economic analysis of the state's actions in the face of a natural disaster (flooding) that occurred in autumn in the southern part of Poland, based on the data contained in the draft law amending the law on special solutions related to removing the effects of flooding and some other laws. The analysis was made using the dogmatic-legal, quantitative and deductive method. The authors addressed the problem of the efficiency of the state's actions in conditions that prevent citizens from functioning properly, in a state of natural disaster introduced in parts of southern Poland. The result of the research is the demonstration of the impact of the new legal regulation on counteracting the effects of flooding and, consequently, on the financial and economic prosperity of the state. The innovative element of the article is the underline of the impact of the normative solutions adopted by the states on the level of public finances in Poland and the formation of macroeconomic indicators. In particular, there is the problem of appropriate protection of the budgets of local government.
