Abstract

Leiharbeit hat in Deutschland in den letzten Jahren rapide zugenommen. Ihre Bedingungen sind vor allem im Arbeitnehmer-Überlassungsgesetz (AÜG) geregelt. Dessen Vorschriften sind in de n letzten Jahren mehrfach geändert worden. Besonders bekannt wurde, dass der Gesetzgeber die zeitliche Begrenzung der Überlassung aufhob und die private Arbeitsvermittlung zuließ. Der Gesetzgeber verankerte die Leiharbeit außerdem in der Betriebsverfassung. Die Gesetzesänderungen und die anschließende Rechtsprechung lösten größere Kontroversen aus . Eine Reihe Politiker und die Gewerkschaften fordern die gesetzliche Ausweitung des Arbeitnehmerschutzes in Leiharbeitsverhältnissen. Andere Politiker und Teile der Wirtschaft verlangen nach weiterem Abbau der beschränkenden Vorschriften. Die vorliegende Broschüre geht auf grundlegende Aspekte der Leiharbeit im Zusammenhang mit dem AÜG ein. Außerdem behandelt sie die Einbettung der Leiharbeit in die Betriebsverfassung sowie die Möglichkeiten und Risiken der tarifrechtlichen Regelung der Branche. Darüber hinaus werden einige Lösungsansätze diskutiert.
