Régimen de insolvencia de la persona natural no comerciante

Abstract

Este libro analiza una de las preocupaciones más vibrantes del derecho concursal en la actualidad, como es la insolvencia del consumidor o de las personas físicas no comerciantes; problemática que ha cobrado especial fuerza en el mundo entero en atención a las crisis económicas recientes que se han experimentado en distintos países, sumadas a varios factores como la adicción al consumo, el sobreendeudamiento, la falta de cultura financiera y, en algunos casos, el otorgamiento irresponsable de créditos. Con la expedición del Código General del Proceso se consagró un régimen de insolvencia para la persona natural no comerciante, inspirado en las modernas tendencias internacionales y que gira alrededor de tres mecanismos: el procedimiento de negociación de deudas, la validación del acuerdo privado y la liquidación patrimonial, los cuales son analizados por el autor con detalle y precisión. Así mismo, el lector encontrará un análisis de los aspectos más sobresalientes de la insolvencia de la persona natural, para concluir con una breve referencia al derecho comparado.
