Silencio y contrato. Del iusnaturalismo al derecho contemporáneo

Abstract

En nuestra obra sobre la incidencia del silencio en los contratos creernos haber demostrado en esencia cuatro cosas: la primera, que la regla contenida en D. 50.17.142 Y según la cual "el que calla ciertamente que no confiesa; pero, sin embargo, es verdad que no niega ", al contrario de lo que mayoritariamente se sostiene, no significaba que el comportamiento silente fuera neutro y por tanto jurídicamente irrelevante, sino que implicaba aceptación porque se refería a la conducta de indefensión que en una actio certae creditae pecuniae asumía el convocado al proceso en la fase in iure del procedimiento formulario romano.
