Gegen Hetze, für die Autonomie der Universitäten: Die Freiheit der Wissenschaft wird auch vor Gerichten verteidigt

Abstract

Erst Anfang der 2000er-Jahre wurde die Freiheit von Wissenschaft und Forschung in einem EU-Dokument explizit festgeschrieben: in Artikel 13 der Grundrechtecharta. Forschende und Institutionen waren auch davor nicht schutzlos – die Verteidigung ihres Freiraums galt als Anwendungsfall der Meinungsfreiheit. Unter welcher Überschrift auch immer: Der Schutz der Wissenschaft vor Instrumentalisierung, Hetzkampagnen und staatlichen Übergriffen wird wichtiger denn je. Kriszta Kovács untersucht, wie die beiden supranationalen europäischen Gerichte, der Gerichtshof für Menschenrechte in Straßburg und der Europäische Gerichtshof in Luxemburg, dieser Aufgabe nachkommen.
