Mögliche Konsequenzen der Umsetzung der EU-Richtlinie zum Management alternativer Investmentfonds für die österreichische Risikokapitalbranche

Abstract

Die "Alternative Investment Fund Managers Directive" (AIFMD) der EU wird in Österreich im Rahmen des Alternative Investmentfonds Manager-Gesetzes (AIFMG) in nationales Recht umgesetzt. Die Regulierungsbereiche des AIFMG wie die Konzession und Erfüllung der Anforderungen, Voraussetzungen für die Verwaltung und den Vertrieb von AIF werden mit Stichtag 22. Juli 2013 implementiert. Die Anforderungen des AIFMG an Struktur, Organisation und Abläufe (z. B. Vergütungspolitik und Vergütungspraxis, Risikomanagement, verpflichtende funktionale und hierarchische Trennung von operativen Abteilungen, Liquiditätsmanagementsystem usw.) werden die österreichische Risikokapitalbranche vor große Herausforderungen stellen.
