Tarifregulierung in der privaten Krankenversicherung

Abstract

Anläßlich der Novellierung des Versicherungsaufsichtsgesetzes, die in Vorbereitung ist, wurde der Verzicht auf die staatliche Aufsicht über die Tarife in der privaten Krankenversicherung ins Auge gefaßt. In Anbetracht der Besonderheiten des Marktes für private Krankenversicherung wäre ein solcher Schritt aus Gründen des Konsumentenschutzes allerdings problematisch: Der Nachfrager nach einer privaten Krankenversicherung kann im bestehenden System einerseits vor Vertragsabschluß nur unzureichende Information über Preis und Qualität der Angebote erlangen, andererseits nach Vertragsabschluß seine Entscheidung nur mit – womöglich hohen – Kosten revidieren. Unregulierter Wettbewerb funktioniert auf diesem Markt daher nicht, staatliche Aufsicht ist erforderlich. Das gilt in jedem Fall für die Einzelversicherung, mit Einschränkungen aber auch für die Gruppenversicherung.
