Abstract

Purpose: The main goal of the research is to attempt to comprehensively present the problem of staffing, which is the least common form of mobbing. The publication includes legal, psychological and managerial aspects of this phenomenon, as well as methods of counteracting this form of violence. Methodology: The research scope of the article is the problem of mobbing and its variety, i.e. staffing. The source material consisted of the case law of the Supreme Court and the Courts of Appeal in the field of mobbing and staffing. The article also used statistical data, commentaries on the Labor Code, as well as scientific articles. The literature on the subject was used in Polish and English. Findings: The conducted research resulted in a comprehensive presentation of the phenomenon of staffing from a legal and managerial perspective, a discussion of the subjective and objective scope of this phenomenon based on the Supreme Court case law, an indication of the entity responsible for staffing and methods of counteracting staffing in employment. Research limitations: Due to the fact that staffing is not a problem often raised by courts, the selection of judgments was limited primarily to those concerning the subject of staffing and conflicts between the superior and the employee. The number of court decisions regarding staffing is limited. The selection of the remaining judgments in the field of mobbing was subjective and adapted to the issues discussed. The limited availability of source literature on staffing also presented a constraint in this work. Practical implications: The topic discussed is of great practical importance because staffing is a form of psychological violence faced by many organizations and management staff. Originality/value: The literature on mobbing is very extensive, but it mainly concerns vertical mobbing, which is directed from the employer/supervisor to the employee, or horizontal mobbing existing between co-workers. However, there is a lack of publications that would comprehensively present the phenomenon of staffing. This article fills the existing gap and answers the most important issues related to this form of harassment, which is an original contribution to science.
