Hukuki̇ Yönden Karşiliksiz Çek Kavraminin Anali̇zi̇

Abstract

Karşılıksız çek keşide edilmesi ile ilgili olarak 6102 sayılı Türk Ticaret Kanunu’nda ve 5941 sayılı Çek Kanunu’nda çeşitli düzenlemeler vardır. Ticari hayatın vazgeçilmezi olan çek uygulaması zamanla birçok sorunu da beraberinde getirmiştir. Bu sorunların çözümü amacıyla ilk olarak 1985 yılında 3167 sayılı “Çekle Ödemelerin Düzenlenmesi ve Çek Hamillerinin Korunması Hakkında Kanun” yürürlüğe konulmuş, ancak zaman içerisinde birçok kez değişikliğe uğramıştır. Daha sonra, 2009 yılı sonunda 5941 sayılı yeni “Çek Kanunu” ile 3167 sayılı Kanun tüm geçici maddeleri ile birlikte yürürlükten kaldırılmıştır. Ancak, 15.7.2016 tarihinde 6728 Sayılı “Yatırım Ortamının İyileştirilmesi Amacıyla Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun”la 5941 sayılı Kanun’da da değişiklikler yapılmıştır. Yapılan değişikliklerle, alışılagelmiş birtakım uygulamalar yürürlükten kaldırılmış, karşılıksız çek keşide edilmesi halinde yapılması gerekenlerle ilgili birtakım boşluklar meydana gelmiştir. Bu kapsamda ise bu makalede Türk Hukuk’unda karşılıksız çek kavramı ile ilgili süreçlerin analizi hedeflenmiştir.
