Abstract

[eng] The law and the relations between farmers and supermarkets in food distribution . In view of rapidly evolving bargaining positions between farmers and supermarket distribution chains, many regulations of all kinds have been edicted recently. In general, they have been poorly efficient in settling and avoiding disputes. It is suggested here that mutually beneficial synergies, deriving from contracts, could be more effective. On such basis, the Law is not a constraint anymore, but rather a tool which helps in reaching agreement. [fre] Les relations entre producteur et grand distributeur ont appelé ces dernières années de nombreuses interventions législatives et réglementaires en raison de la position de force occupée successivement par les producteurs d'abord, par les grands distributeurs ensuite. La faible efficacité de ces dispositions doit incliner les producteurs comme les grands distributeurs à utiliser des formules contractuelles pour développer entre eux des synergies. Le droit n'est plus alors une contrainte opposée au conflit mais un instrument proposé pour l'accord.
