Abstract
[eng] Supplementary sickness insurance in health care management : towards a cooperative model ? The French Act of 13 August 2004 reforming the public health insurance system contains provisions aimed at organising the partnership between the two forms of healthcare funding : compulsory regimes and supplementary sickness insurance. In other words, the state intends to settle the various levels of compulsory and top-up cover. But as well as providing the now standard « terms of reference » for market participants and establishing a representative body, the Act will also give players the means to co-operate over a common management agreement. . After providing several definitions for the lay reader and an overview of the current situation, the authors take a quick look back at the scenarios envisaged at the opening of the millennium. Finally, they discuss the main provisions of the Act and identify the conditions of its success, particularly as regards the positions of the various social partners. . JEL classification : I11, I18 [fre] La Loi du 13 août 2004, portant réforme de l'assurance maladie, contient des dispositions qui visent à organiser le partenariat entre les deux acteurs du financement : les régimes obligatoires et l'assurance maladie complémentaire. L'État va ainsi organiser les différents niveaux de couverture obligatoire et complémentaire. Mais au-delà du désormais classique « cahier des charges » défini pour les opérateurs de marché, au-delà de la création d'une instance représentative, la Loi va aussi donner aux acteurs les moyens de coopérer sur un contrat commun de régulation. Dans cet article, après quelques définitions nécessaires aux non spécialistes du domaine et un état des lieux de la situation, les auteurs proposent un bref retour en arrière, présentant les scénarios envisagés au début des années 2000. Enfin, ils discutent les principales dispositions de la loi pour dégager les conditions de la réussite, notamment au regard des positions des différents partenaires. . Classification JEL : I11, I18
