Les Contrats De Parteneriat Entre Le Secteur Public Et Les Entreprises Privees

Abstract

Le contrat du partenariat publique -privé ne représente pas une apparition accidentelle dans la grande catégorie des contrats, compte tenu de la tradition dans le droit administratif d’entre les guerres, soit-il français ou roumain. Il s’est développe dans le contexte de l’apparition et de la consolidation des normes du droit communautaire. Sur ce fondement soutenu par les facteurs politiques, économiques, sociaux et juridiques, on peut observer l’apparition de la Carte Verte des contrats de partenariat publique-privé et le droit communautaire des acquisitions publiques et des concessions adoptée par la Commission Européenne le 30 avril 2004 pour créer, adopter, aligner les règles et les principes spécifiques pour la coopération dans le secteur public et privé. Établir la nature du contrat de partenariat publique -privé comme un contrat administratif représente une démarche de recherche scientifique pour situer ce contrat dans un cadre institutionnel profitable pour les parties impliquées
