Les voies d'attaque contre les documents émis par les autorités contractantes en ce qui concerne les acquisitions publiques. La procédure devant le Conseil National de Solution des Contestations

    En attendant le moment de l’adhésion de la Roumanie à l’Union Européenne, une Ordonnance d’urgence gouvernementale a été adoptée, la no. 34 du 19 avril 2006 concernant l’attribution des contrats pour l’acquisition publique, des contrats de concession des travaux publics et des contrats de concession des services. Par dérogation du droit commun établi par la loi du contentieux administratif no. 554/2004, la loi d’acquisition publique a déterminé en manière expresse que l’autorité compétente à solutionner la contestation formulée contre un document délivré par les autorités contractantes concernant les acquisitions publiques est le Conseil National de Solution des Contestations. En ce qui concerne l’O.U.G. 34/2006, elle confère une compétence exorbitante au Conseil National de Solution des Contestations, organisme avec des attributions administratives juridictionnelles, qui déborde même celle de l’instance judiciaire, être capable de prendre une décision qui peut : annuler en partie ou en complet un document administratif, elle force l’autorité contractante d’émettre un document ou elle peut disposer n'importe quelle mesure nécessaire pour remédier les documents qui affectent la procédure d’attribution. A la fin nous arrêterons sur l’analyse de la procédure devant le Conseil National de Solution des Contestations
