Abstract

La Loi no. 59/1993 pour la modification du Code de procédure civile, du Code de la famille, de la Loi du contentieux administratif no. 29/1990 et de la Loi no. 94/1992 concernant l’organisation et le fonctionnement de la Cour de Comptes de la Roumanie a réintroduit le recours dans l’intéret de la loi, celui-ci étant réglementé par les dispositions de l’art. 329 du Code de procédure civile. Essentiellement, le recours dans l’intéret de la loi est devenu une extraordinaire voie d’attaque ayant le rôle d’assurer l’interprétation et l’application unitaire de la loi. Le probleme comporte une grande importance pour les praticiens du droit mais aussi pour les théoriciens, ces aspects ne faisant pas l’objet d’une étude distincte ou d’une polémique doctrinaire générée par des opinions contradictoires. Notre étude traitera en bref une possible mais légale aussi - nous l’estimons- mise en question de cette problématique
