Considerations on Concluding Insurances

Abstract

Le contrat d’assurance ne peut se conclure dans la hâte. Parce qu’il exige une appréciation des risques que l’assureur va accepter de couvrir, parce que la garantie qu’il va accorder aura des conséquences parfois considérables dans la vie de l’assuré, la loi veille avec un soin qu’on ne retrouve dans aucun autre contrat spécial à ce que la phase précontractuelle soit un temps de conseil et de réflexion. Ensemble, la loi et la jurisprudence organisent une élaboration minutieusse et réfléchie du contrat d’assurance. D’une part, l’intermédiaire d’assurance est astreint à un devoir de conseil particulièrement exigeant. D’autre part, l’attention de l’assuré est attirée par une formalisation exceptionnelle de la phase précontractuelle, tant dans l’assurance individuelle que dans l’assurance de groupe
