Umkämpfte Mitbestimmung: Ergebnisse der dritten WSI-Befragung zur Be- und Verhinderung von Betriebsratswahlen

Abstract

This article presents the findings of the third survey on employer resistance to works councils. The survey was carried out amongst local trade union organisations and completed in 2019. It is a follow-up study to two similar surveys amongst local trade union organisations conducted by the WSI in 2012 and 2015. The findings confirm that the establishment of a works council is a contested issue. In particular the obstruction and prevention of the election of works councils by employers is found amongst owner-operated small and medium-sized establishments. The article reflects the existing system of industrial relations in Germany and employer resistance to works councils before presenting the survey and its evidence. It concludes with a brief examination of the possible reasons for why about half of the reporting union organisations were not aware of any employer interference with works council elections while others reported several instances of such activity.
