Zur Vergütung von Arbeitnehmererfindungen als ökonomisches Allokationsproblem: Ein spieltheoretischer Lösungsansatz

Abstract

According to § 9 ArbnErfG the employer has to pay a fair compensation to the employee when he takes advantages of an invention that is made by the employee. It is questionable how this compensation could be set, because both parties contributes to the invention. When the employee disagrees with the suggestion of the employer, he can call the mediation court at the “Patentamt” or an ordinary court. A referee has to set an arbitration value which can lead to a balance of interests. This paper highlights this allocation problem and discusses different models for the allocation of economic value and the negotiation concerning the invention of an employee.
