Consideratii asupra reglementarii autoritatii parintesti in noul Cod civil [Considerations on the regulation of the paternal authority in the new Civil Code]

Abstract

The parental authority is a new notion in the family law, introduced by the civil code, which sets to rights the general framework regarding the parental rights and obligations. From the point of view of the content, this notion is similar to that of parental protection from the family code. The content of the parental authority is the same for every child no matter weather the child comes from the marriage or outside the marriage or from adoption. The personal relations between a parent and his child represent a fundamental element of the family life, even if the relation between parents has changed.
