Nulitatea absoluta si nulitatea relativa: Cauze si regim juridic [Absolute nullity and relative nullity: Causes and juridical regime]

Abstract

In this article I presented in detail the causes of absolute nullity and relative nullity of the juridical civil act, so that these can be easily distinguished by all the interested persons. Also, I made a comparison between the juridical regime applicable to the absolute nullity and to the relative nullity of the juridical civil act. This paper contains contradictory opinions of the different authors from the specialty literature, examples from the judicial practice in civil law and family law, as well as a comparison between the nullity provisions from the Civil Code of 1865, updated in 1997, and from the Civil Code of 2009 – Law no. 287/17.07.2009.
