Abstract

Whoever we are, wherever we live and in all circumstances, we all have the ability to create. This human creativity and innovation is able to improve our quality of life, in all domains. The purpose of intellectual property is to promote the conditions that enable creativity and capacity for innovation to bear fruit on a planetary scale. Intellectual property rights are social constructions whose objective is to promote the wellbeing of society. They have become a major issue in trade negotiations and in the growth strategies of developed countries. What separates developed from developing countries, is a gap in knowledge. Inappropriately designed regimes of these rights can present an important impediment to closing the knowledge gap and therefore to development.
