La Justicia Financiera Ante Los Desafíos Del Estado Autonómico

Abstract

La Constitución Española proclama un catálogo de valores con significativas implicaciones para la construcción de la justicia financiera a través de su materialización mediante principios y derechos, vertebrando la ordenación jurídica de ingresos y gastos públicos, y guiando la actuación de la pluralidad de entes públicos territoriales en el marco del Estado autonómico. Como consecuencia de la descentralización progresiva experimentada por el Estado español, actualmente en discusión, surgen nuevos desafíos para la justicia financiera vinculados a la realización de los derechos constitucionales, que exigen de la implementación de construcciones, como el principio de proporcionalidad, para la efectividad del «Estado social y democrático de Derecho»
