Exención Por Rendimientos Obtenidos Por Trabajos En El Extranjero: Evolución, Requisitos Y Problemática Práctica

Abstract

La exención de las rentas obtenidas como consecuencia de trabajos ejercidos efectivamente en el extranjero fue introducida en nuestro ordenamiento por el artículo 7.p) de la Ley 40/1998, de 9 de diciembre. Tal exención ha sufrido múltiples variaciones hasta la redacción vigente en la actualidad. El presente trabajo pretende detallar la evolución de la mencionada exención, así como los requisitos exigidos para la aplicación de la misma, y analizar la problemática observada en la práctica y derivada de las actuaciones de los órganos de la Administración Tributaria y de los correspondientes órganos jurisdiccionales.
