Abstract

En este trabajo abordamos el estudio de la prestación del servicio público por parte del ente público en general y del ente local en particular y su sujeción o no al IVA, atendiendo a la forma de prestación del servicio. Para ello, haremos un análisis de los Ayuntamientos como sujetos pasivos del IVA y de las actividades ejercidas por éstos cuando estén sujetas al impuesto, todo ello no sólo a efectos de la actuación del ente local cuando ejercite la actividad a través de sus funcionarios o personal, sino también cuando actúen por medio de entes instrumentales, como los organismos autónomos, entidades públicas empresariales o sociedades municipales, así como también se hará especial referencia a la aparición de los particulares en este tipo de actuación.
