La Aplicación Del Iva En El Ámbito Del Comercio Electrónico

Abstract

El presente trabajo tiene por objeto analizar las principales cuestiones conflictivas que suele plantear la aplicación del Impuesto sobre el Valor Añadido en las operaciones de comercio electrónico. Nos referimos, concretamente, a la necesaria calificación de los bienes entregados y de los servicios prestados, así como a la determinación del lugar de realización de la operación a efectos de su sometimiento a gravamen por el IVA. De cara al análisis de estas y otras cuestiones el autor toma como punto de referencia la evolución normativa que se ha producido a este respecto dentro del ámbito de la Unión Europea. Asimismo es objeto de estudio el régimen especial aplicable dentro del citado Impuesto a los servicios prestados por vía electrónica, con especial atención a sus principales aspectos configuradores: ámbitos subjetivo y objetivo de aplicación, obligaciones formales y registrales, etc.
