Los Criterios De Graduación De Las Sanciones Tributarias Establecidos En La Ley General Tributaria

Abstract

En las páginas que siguen se compara la regulación que de los criterios de graduación de las sanciones se contenía en la LGT de 1963 y en el RD 1930/1998, ya derogados, y la que se efectúa en la actual LGT y en el RD 2063/2004. Se pone de relieve que ni son criterios de graduación todos los que están en el art. 187 LGT, ni en este precepto están todos los que son. Y, finalmente, se realiza un análisis en profundidad de todos y cada uno de los criterios de graduación de las sanciones establecidos en el Título IV de la LGT 2003, se establezcan o no en el art. 187 LGT, y se llama la atención sobre los aspectos más criticables de su regulación.
