Los Planes De Pensiones De Empleo En La Ley 35/2006 Del Irpf

Abstract

El trabajo analiza el régimen jurídico-¬tributario de los Planes de Pensiones en la nueva Ley del Impuesto sobre la Renta de las Personas Físicas desde la doble perspectiva de, por un lado, las contribuciones empresariales y las aportaciones del partícipe y, por otro, de las prestaciones de estos instrumentos de ahorro-¬previsión a favor de sus beneficiarios. El estudio se inicia con una breve exposición del régimen sustantivo de este instrumento financiero y continúa con el análisis de la nueva regulación contenida en la Ley 35/2006, teniendo en cuenta, también, los precedentes legislativos y la finalidad declarada de la reforma del impuesto. Además, se analizan otras cuestiones como la posibilidad de practicar reducciones por las cantidades aportadas a planes de pensiones concertados con entidades situadas en otros países de la Unión Europea y las cantidades aportadas a los planes de personas discapacitadas o del cónyuge del contribuyente.
