La Expansión Y Control De Los Tax Shelters En Estados Unidos

Abstract

Los Tax Shelter, una modalidad de asesoría fiscal típicamente americana, no han tenido hasta ahora traducción en nuestro país, probablemente porque el fenómeno no se ha reproducido aquí y, si lo ha hecho, no ha sido con la misma virulencia. Sin embargo, en los países sajones ha sido la moda durante más de quince años hasta que, desde 1999, se incorporó a los planes contra el fraude. Lo novedoso no es tanto su concepción, similar al fraude de ley, sino su presentación, por comercializarse como una solución de inversión dirigida a miles de contribuyentes, multiplicando el drenaje de los recursos tributarios y dañando la moral contributiva por la cobertura mediática. Aquí se analiza el fenómeno y las medidas legales que, parece ser, han estabilizado este problema en EEUU.
