Le limitazioni della responsabilit? erariale per la gestione dell?emergenza epidemiologica tra "decreto semplificazioni" e "decreto cura Italia": un sistema a geometria variabile

Abstract

L?articolo analizza brevemente le modifiche apportate alla disciplina della re-sponsabilit? erariale dal d.l. 16 luglio 2020, n. 76 (c.d. "decreto semplificazioni") e dal d.l. 17 marzo 2020, n. 18 (c.d. "decreto cura Italia"). I menzionati decreti-legge, nell?introdurre limitazioni a questa forma di responsabilit? con specifico riferimento all?elemento soggettivo, rivelano talune criticit? in punto di compati-bilit? con l?art. 77 Cost. e con altri principi costituzionali, potendosi dubitare, in particolare, in ordine al rispetto del principio di responsabilit? dei pubblici poteri e dei loro agenti, che anche in tempo d?emergenza deve ritenersi insuscettibile di deroghe, soprattutto attraverso l?esercizio del potere di decretazione d?urgenza
