Abstract

Il Contributo affronta il tema del controllo analogo nelle societ? pubbliche ricostruendo l?origine dell?istituto e i presupposti del controllo, tenendo conto dell?evoluzione che ha avuto sul tema la giurisprudenza nazionale e, prima ancora, comunitaria. In particolare vengono analizzate le problematiche connesse alla nozione di controllo analogo congiunto e approfonditi i presupposti dell?esercizio del controllo, considerandone la disciplina alla luce del Testo Unico Societ? Pubbliche. La problematica del controllo ? cos? inserita nel tema dell?affidamento in house, tenendone conto le implicazioni che hanno determinato l?evoluzione della disciplina del controllo analogo
