Politica commerciale comune, controlli all?esportazione e sistemi nazionali

Abstract

Con questo breve saggio intendiamo svolgere alcune considerazioni sull?impatto che le misure nazionali di controllo delle esportazioni possono avere sulla Politica commerciale comune dell?UE. Il sistema adottato dall?Unione Europea per stabilire un regime unitario di controllo delle esportazioni di beni strategici (duplice uso-Dual use) non garantisce l?uniformit? delle condizioni tra gli operatori economici dei diversi Stati membri. Il tentativo di trovare un equilibrio tra le esigenze della Politica commerciale comune e le ragioni della politica estera e di sicurezza nazionale crea aree di discrezionalit? in grado di compromettere l?uniformit? della disciplina. ? necessario identificare i limiti alla discrezionalit? delle autorit? nazionali. Ci? richiede anche la necessit? di un adeguato controllo della legittimit? degli atti delle autorit? competenti da parte dei tribunali nazionali. Solo un controllo efficace da parte della magistratura pu? limitare i pericoli di distorsione delle pari opportunit? e condizioni per gli operatori di diversi Stati membri dell?UE.
