Lei das contravenções penais e sua real efetividade no município de Monte Castelo no período de 2008 a 2012

Abstract

Durante el periodo de la dictadura, después de que Brasil sufriera un golpe de Estado, llevado a cabo por Getulio Vargas en 1930, que dio lugar a un nuevo sistema político, conocido como “Nuevo Estado”, se hizo necesario la creación de normas que permitieran establecer el orden y la seguridad del Estado. Así, la Ley de Delitos Menores Penales, publicada por el Decreto-Ley nº 3688, el 3 de octubre de 1941. Sin embargo, después de 70 años de vigencia, dicha ley es considerada por algunos autores, como vetusta, puesto que fue promulgada antes de la Constitución Federal de 1988, y por eso se cuestiona su aplicabilidad. A su vez, la misma sigue vigente hasta nuestros días, pero con algunas modificaciones debidas a la evolución de la sociedad. Es en este aspecto en el que se pretende desarrollar este estudio, analizando la eficacia (ineficacia) de esta Ley, a través de la realidad de su aplicación práctica en el municipio de Monte Castelo, Estado de Santa Catarina, durante el periodo 2008-2012.
