La respuesta desde el urbanismo a la efectividad del derecho a la vivienda tras la Ley 12/2023 y su desarrollo en el País Vasco: novedades legislativas y jurisprudenciales

Abstract

La entrada en vigor de la Ley 12/2023, de 24 de mayo, por el derecho a la vivienda y la posterior jurisprudencia del Tribunal Constitucional introduce novedades muy significativas en materia de la relación entre el urbanismo y derecho a la vivienda. El artículo pro­pone analizar estas novedades para contrastar la recepción que se ha hecho de las mismas en la vigente legislación vasca, así como en las iniciativas legislativas propuestas en el Parlamento Vasco. Finalmente, el artículo propone una batería de medidas que podrían arti­cularse desde el urbanismo para hacer efectivo el derecho a la vivienda en base al marco legislativo vigente, como mandata el artículo 47 de la Constitución.
