Principales novedades en la regulación de los derechos de autor ante las nuevas tecnologías

Abstract

This article has the objective of displaying the legal particularities concerning the protection of the copyrights of data processing creations. These particularities stem, in the first place, from the need to understand the requisite of originality in a less rigorous manner for computer programs and databases. Secondly, there is the need to reinforce the patrimonial rights on such works, covering both the monopoly on the works and the strict configuration of the limits thereof, in comparison with other literary, scientific or artistic works. And, thirdly, there is the emergence of a sui generis right on data bases that constitutes an important novelty reference to the traditional configuration of intellectual property rights.
