Isyerinde Psikolojik Tacizin (Mobbing) Tarihsel Arka Plani ve Türk Hukuk Sisteminde Yeri

Abstract

Isveren tarafindan kasitli olarak sürekli ve sistematik bir sekilde duygusal saldiri yoluyla yipratilmasi anlamini tasimaktadir. Böylelikle fiziksel, sosyal ve ruhsal acidan magdur edilerek bireysel anlamda iscinin is basarisi ve verimliliginin düsmesine, hatta iscinin isten ayrilmasina neden olabilecek, örgütsel anlamda ise örgüt barisinin bozulmasina sebep olarak örgütsel verimlilige ve dolayisiyla ülke ekonomisine olumsuz etki yapabilecek ciddi bir sürectir. Mobbingin hem calisanlar, hem de örgüt acisindan bu derece önem arz etmesi bu olguya karsi hukuki anlamda önlem alma ihtiyacini dogurmustur. Ancak günümüzde bircok gelismis ülkede, mobbingin teshis ve sonuclarina yönelik arastirmalarin yapildigi, ayrica sözkonusu türde tacizlerin önlenmesi ve mevcut taciz eylemlerinin neden oldugu bireysel ve örgütsel zararlarin giderilmesi icin hukuki tedbirlerin alindigi gorülürken, kavram mevzuatimizda henüz acikca yer almamaktadir. Bununla birlikte, mobbingin isyerlerindeki psikolojik ve örgütsel etkileri göz önünde bulundurularak Türk Hukuk Mevzuatinda da acikca yer almasi yönündeki calismalarin Borclar Kanunu Tasarisi ile gerceklestirilmeye calisildigi görülmektedir. Bu calismada mobbing olgusunun kavramsal cercevesi ve kapsamindan yola cikarak Türk Hukuk Mevzuatindaki yeri incelenmistir.
