EU-Verfahren gegen die Novelle des Telekommunikationsgesetzes gefährdet Liberalisierung

Abstract

Am 26. Februar 2007 hat die EU-Kommission ein beschleunigtes Vertragsverletzungsverfahren gegen Deutschland wegen der Einführung von angeblichen "Regulierungsferien" in dem jüngst novellierten Telekommunikationsgesetz (TKG) eröffnet. Die Kommission vermutet, dass die dort getroffene Ausnahmeregelung für "neue Märkte" speziell die Deutsche Telekom gegen Wettbewerb beim Ausbau des neuen Breitband-Hochgeschwindigkeitsnetzes (VDSL) schützen soll. Die Position der EU-Kommission ist aus mehreren Gründen abzulehnen: Tatsächlich schreibt die TKG-Novelle vor, dass die Bundesnetzagentur grundsätzlich "neue Märkte" nicht unter die Ex-ante-Regulierung stellen soll, wenn hierdurch keine langfristige Behinderung des Wettbewerbs zu erwarten sei. Diese Regelung ist kein "Lex Telekom", sondern gilt für alle Unternehmen, die durch Investitionen Vorreitervorteile mit neuen Telekommunikationsnetzen und -diensten erlangen. Die in der Novelle vorgeschlagene Behandlung neuer Märkte fördert auch die Investitionsanreize der Wettbewerber, während der Ansatz der EU-Kommission das Gegenteil bewirkt. Damit gefährdet das von ihr initiierte Vertragsverletzungsverfahren den Liberalisierungsprozess und fördert stattdessen eine exzessive Regulierung.
