Abstract
Complementing the statutory pay-as-you-go pension system in Germany by a publically subsidised system of capital-funded private pensions makes sense. However, the existing system suffers from some central weaknesses: the defective regulation regarding commission-based selling of policies, systemic negative incentives in the provision of financial advice to potential consumers of private pensions products, along with excessive fees payable by policyholders when they first buy the policies, run counter to the intention of the “Riester” system of private pensions and undermine its political legitimation. The authors believe that a new consumer-policy approach is necessary, including a further-reaching regulatory framework for the provision of financial advice and for the fee structures of private pension schemes, along with stronger emphasis on sustainability aspects for publically subsidised pension policies. In addition, the authors discuss the idea of a basic product organised by the state. Die Ergänzung der gesetzlichen umlagefinanzierten Altersvorsorge durch eine öffentlich geförderte kapitalgedeckte private Altersvorsorge in Deutschland ist sinnvoll. Allerdings krankt das gegenwärtige System an zentralen Punkten: Die mangelhafte Regulierung des provisionsorientierten Vertriebs, systemimmanente Fehlanreize bei der Finanzberatung zu privaten Altersvorsorgeprodukten sowie überhöhte Abschluss- und Vertriebskosten konterkarieren die Intention der Riesterrente und untergraben ihre politische Legitimation. Ein notwendiger verbraucherpolitischer Neustart der öffentlich geförderten privaten Altersvorsorge beinhaltet nach Ansicht der Autoren unter anderem die weitergehende Regulierung der Finanzberatung und der Kostenstruktur bei der privaten Altersvorsorge und die stärkere Berücksichtigung von Nachhaltigkeitsaspekten bei geförderten Altersvorsorgeverträgen. Darüber hinaus wird die Idee eines öffentlich organisierten Basisproduktes diskutiert.
