Acceso a la justicia y exclusión estructural: diagnóstico crítico de las barreras institucionales en Chile

Abstract

El presente artículo analiza las barreras de acceso a la justicia en Chile desde una perspectiva estructural, sosteniendo que dichas barreras no operan de manera aislada ni contingente, sino como un entramado de factores sociales, económicos, culturales e institucionales que reproducen dinámicas de exclusión en el funcionamiento del sistema judicial. A partir de un enfoque doctrinal y crítico, el trabajo identifica y examina las principales barreras que afectan el ejercicio efectivo del derecho de acceso a la justicia, tales como las desigualdades económicas, las limitaciones geográficas, las barreras culturales y lingüísticas, la discriminación estructural, así como déficits institucionales asociados a la complejidad, lentitud e ineficacia del sistema judicial
