Reform der Erbschaftsteuer: Zwischen rechtspolitischem Ideal und realistischen Möglichkeiten

Abstract

Die Erbschaftsteuer hat trotz ihres vergleichsweise geringen Beitrags zum Gesamtsteueraufkommen eine hohe politische und symbolische Bedeutung, weil sie Fragen der Verteilungsgerechtigkeit, wirtschaftlichen Leistungsfähigkeit und familiären Vermögensnachfolge berührt. Verfassungsrechtlich verfügt der Gesetzgeber über einen weiten Gestaltungsspielraum, wird jedoch insbesondere durch den Gleichheitssatz sowie den Schutz von Ehe, Familie und Erbrecht begrenzt. Die aktuelle Ausgestaltung mit hohen Steuersätzen und weitreichenden Verschonungen für Betriebsvermögen steht erneut unter verfassungsrechtlicher Prüfung und weist erhebliche Gerechtigkeits- und Effizienzprobleme auf. Als Reformperspektive wird ein System mit breiter Bemessungsgrundlage und niedrigen Steuersätzen diskutiert, dessen politische Durchsetzbarkeit jedoch zweifelhaft erscheint.
