Abstract

Eine kurze Pressenotiz der OECD vom 3. Dezember 1998 gab bekannt, daß die Verhandlungen über das "Multilateral Agreement on Investment" (MAI) eingestellt wurden. Der Versuch, sich im Rahmen der OECD über verbindliche Regeln für den Investitionsschutz zu einigen, ist also vorerst gescheitert. In dem Beitrag wird der Frage nachgegangen, weshalb das Abkommen, das auf den zwei zentralen Prinzipien nationale Gleichbehandlung und Meistbegünstigung basieren sollte, nicht zustande kam, und es werden die Möglichkeiten diskutiert, z.B. im Rahmen der WTO doch noch einen international anerkannten Rechtsrahmen für grenzüberschreitende Investitionen zu schaffen.
