Technischer Fortschritt und staatliche Regulierung : Zähmung des Zufalls durch Wissenschaft und Technik?

Abstract

Der Autor greift eine Thematik auf, mit der sich das ifo Institut bereits mehrfach aus ökonomischer und ökologischer Sicht auseinandergesetzt hat. Mit dem Gesetz zur Beschleunigung von Genehmigungsverfahren hat dieses Thema 1996 eine brandneue Aktualität erfahren. Das bundesgesetzliche Regelwerk üßberläßt Genehmigungsbehörden auf der Länderebene einen erheblichen Entscheidungsspielraum, der die technologische Wettbewerbsfähigkeit der Unternehmen behindern oder einschränken kann. Würden daraus Standortvorteile oder -nachteile auf der Ebene der Bundesländer resultieren, dann wäre das weder rechtmäßig noch aus ordnungspolitischer Sicht akzeptabel. Solche Wettbewerbsbeeinträchtigungen haben vor allem im internationalen Standortwettbewerb aufgrund der Öffnung der Märkte, der Technoglobalisierung und der Globalisierungsstrategien der deutschen Unternehmen erheblich an Bedeutung gewonnen. Warum das so ist und welche Herausforderungen daraus für den Gesetzgeber resultieren, wird am Beispiel der Hochtechnologie demonstriert.
